Attachment No. 1: Withdrawal form - example

1. DEFINITIONS
Working days - days from Monday to Friday except for public holidays.
Buyer - a consumer within the meaning of the Civil Code.
Account - a free-of-charge function of the Shop (service provided electronically), thanks to which the Buyer can create his/her individual account in the Shop.
Buyer - any entity buying from the Shop.
Privileged Buyer - a Consumer or Privileged Entrepreneur.
Privileged Trader - a natural person concluding a contract with the Seller directly connected
his/her business activity, but which does not have a professional character for him/her (the definition is valid for
contracts concluded as of 1 January 2021).
Basket - an element of the Shop's software where the products selected by the Customer for purchase are visible and where it is possible to determine and modify the Order data, in particular the quantity of the products.
Order - a declaration of will of the Customer placed via the Basket and aimed directly at the conclusion of a sales agreement.
Sales Supervisor - sales representative of Rotometal DBN sp. z o.o.
Rules and Regulations - these Rules and Regulations.
Shop - online shop of Rotometal DBN sp. z o.o. run by the Seller at the address Rotometal.com.

2. TECHNICAL REQUIREMENTS
(1) The proper functioning of the Store requires: a device with Internet access, web browser that supports JavaScript and cookies.
(2) In order to make an Account in the Store and an Order with a form of payment: pro forma, an active e-mail account is necessary.

3. PAYMENTS
1. an Order may be paid for, depending on the Buyer's choice:
a. by simple transfer to the Seller's bank account;
b. via the payment platform: Mollie
c. after having been granted trade credit using the "pay later" form.
2. if the Buyer chooses to pay in advance, the Customer undertakes to pay within 3 working days
after placing the order.
(3) By purchasing from the Shop, the Buyer accepts the use of electronic invoices by the Seller.
The Buyer has the right to withdraw his acceptance.
(4) If an individual payment term for the Order has been agreed with the Sales Supervisor, the details concluded between the Buyer and the Sales Supervisor shall apply.


4. ORDER COMPLETION
(1) The Seller is obliged to deliver goods without defects.
(2) The time limit for the fulfillment of the order is indicated in the Shop.
(3) In the case where the Buyer has chosen to pay in advance for the order, the Seller shall proceed to carry out the order after receiving payment and determining the details of the product and delivery time.
(4) If the Buyer has purchased goods with different lead times within one order,
the order will be completed within the time limit applicable to the goods with the longest time limit. (5) Goods are delivered in the countries listed in the shopping cart when selecting the delivery address.
(6) Goods purchased from the Shop are delivered by:
a. courier company
b. the Customer's own transport
c. transport of Rotometal DBN sp. z o.o.
d. carriers acting on behalf of Rotometal DBN sp. z o.o.
(7) The Buyer may collect the goods in person at the company's headquarters during its opening hours.
(8) if the Buyer chooses to collect in person, the Buyer is obliged to arrange in advance the details of the collection date with the Sales Supervisor.


5. RIGHT OF WITHDRAWAL
(1) A privileged Buyer has the right to withdraw from a contract concluded with the Seller through the Shop,
subject to § 6 of the Terms and Conditions, within 14 days without giving any reason.
(2) The period to withdraw from the contract shall expire after 14 days from the date:
a. on which the Priority Buyer has taken possession of the goods or on which a third party other than the carrier and indicated by the Priority Buyer has taken possession of the goods;
b. on which the Priority Buyer has taken possession of the last of the goods or on which a third party,
other than the carrier and designated by the Priority Buyer, has taken possession of the last of the goods in the case of a contract involving the transfer of ownership of several goods which are delivered separately.
(3) In order for the Priority Buyer to exercise his right of withdrawal, he must inform the
Seller, using the data specified in § 10 of the Terms and Conditions, of his decision to withdraw from the contract by an unequivocal statement (for example, a letter sent by post or information sent by e-mail to e-mail address rotoshop@rotometal.com).
(4) A privileged buyer may use the “Withdrawal form – example” located at the
end of the Terms and Conditions, but this is not obligatory.
(5) In order to comply with the withdrawal period, it is sufficient for the privileged Buyer to send information concerning the exercise of his/her right of withdrawal before the expiry of the withdrawal period.


EFFECTS OF WITHDRAWAL
(6) In the event of withdrawal from the concluded contract, the Seller shall return to the privileged Buyer all payments received from him, including the costs of delivering the goods (except for the additional costs resulting from the privileged Buyer's choice of a delivery method other than the
the cheapest ordinary delivery method offered by the Seller), immediately and in any case
no later than 14 days from the day on which the Seller was informed of the decision of the privileged Buyer to exercise his right of withdrawal.
(7) The Seller shall refund the payment using the same means of payment as were used by the
privileged Buyer used in the original transaction, unless the privileged Buyer agrees
otherwise, in any case, the Priority Buyer shall not incur any charges in connection with the
this refund.
(8) The Seller may withhold reimbursement until he has received the goods or until he has
received a proof of its return, whichever event occurs first.
(9) The Seller requests that goods be returned to: Rotometal DBN Sp. z o.o. Jana III Sobieskiego 14; 66-200 Świebodzin immediately, and in any case no later than 14 days from the day on which the privileged Buyer informed the Seller about the withdrawal from the sales agreement. The deadline is met if the privileged Buyer sends back the goods before the expiry of the 14-day period.
(10) The privileged Buyer shall bear the direct costs of returning the goods.
(11) The privileged Buyer shall only be liable for the diminished value of the goods resulting from the use of the goods in a manner other than that which was necessary to ascertain the nature, characteristics, and functioning of the goods.
(12) If the Seller returns the goods to the Privileged Buyer, the Privileged Buyer shall bear the direct costs of returning the goods. The Privileged Buyer will be informed of the estimated amount of these costs by the Seller.


6. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
(1) The right of withdrawal from a contract concluded at a distance, as referred to in § 5 of the Terms and Conditions, shall not be granted with regard to a contract:
a. in which the subject matter of the performance is a non-generic item produced according to the specifications of the privileged buyer or serving to satisfy his individualized needs;
b. in which the object of the performance is an item that is perishable or has a short
shelf life;
c. in which the subject of the performance is an item supplied in a sealed package that cannot be returned after opening the packaging cannot be returned for health or hygiene reasons,
if the packaging has been opened after delivery;
d. in which the object of the performance is an item which, after delivery, by its nature,
are inseparably connected with other things;
e. where the subject matter of the performance is sound or visual recordings or computer programs
delivered in sealed packaging if the packaging is opened after delivery;
f. for the supply of newspapers, periodicals, or magazines, with the exception of a subscription contract;
g. in which the price or remuneration depends on fluctuations in the financial market which the Seller does not control and which may occur before the end of the withdrawal period.


7. COMPLAINTS
(1) In the event of a defect in the goods, the Buyer has the right to complain about the defective goods on the basis of the warranty or guarantee regulated by the Civil Code, provided that the guarantee was granted.
(2) Using the warranty, the Buyer may, under the terms and within the time limits specified in the Civil Code:
a. make a declaration of price reduction,
b. in the case of a material defect - make a declaration on withdrawal from the contract,
c. demand that the item be replaced with a defect-free one,
d. demand removal of the defect.
(3) The Seller asks for submitting the complaints on the basis of the warranty to the postal or electronic address indicated in § 10 of the Terms and Conditions.
(4) if it turns out that in order to consider the complaint it is necessary to deliver the defective goods to the Seller, Buyer is obliged to deliver the goods at the Seller's expense to the address of Rotometal DBN Sp. z o.o. Jana III Sobieskiego 14 66-200 Świebodzin.
(5) Complaints regarding the operation of the Shop should be sent to the e-mail address indicated in § 10 of the Terms and Conditions.
(6) The Seller will consider the complaint within 14 days of its submission.


OUT-OF-COURT COMPLAINT AND REDRESS PROCEDURES
7 In the event that the complaint procedure fails to produce the result expected by the Buyer,

c. the free assistance of the municipal or district consumer ombudsman;

8. PERSONAL DATA
(1)The administrator of the personal data provided by the Buyer during the use of the Shop is the
Seller. Detailed information concerning the processing of personal data by the Seller - including other purposes and including other purposes and grounds for data processing, as well as recipients of the data - are contained in the available Shop's Privacy Policy - due to the transparency principle contained in the general Regulation of the European Parliament and of the Council (EU) on data protection - "RODO".
(2) The purpose of the processing of the Buyer's data by the Seller, provided by the Buyer in connection with the purchases in the Shop, is to process orders. The basis for the processing of personal data in this case is:
the contract or actions taken at the request of the Buyer aimed at its conclusion (Art. 6(1)(b)
RODO), the Seller's legal obligation relating to accounting (Article 6(1)(c)), and the Vendor's legitimate interest in processing data in order to establish, investigate or defense of possible claims (Article 6(1)(f) RODO).
(3) The provision of data by the Buyer is voluntary, but at the same time necessary for the conclusion of the contract.
Failure to provide data will prevent the conclusion of a contract in the Shop.
4. the Buyer's data provided in connection with purchases in the Shop will be processed until:
a. the contract concluded between the Buyer and the Seller is no longer valid;
b. the Seller is no longer legally obliged to process the Buyer's data; c. the Seller is not obliged to process the Buyer's data.
c. the possibility of asserting claims by the Buyer or Seller related to the contract concluded by the Shop ceases to exist.
d. the Buyer's objection to the processing of his personal data is accepted - in the case when the
the basis of data processing was a justified interest of the Seller - whichever is applicable in a given case and which occurs at the latest.
(5) The Buyer shall have the right to request:
a. access to his personal data,
b. rectification,
c. erasure,
d. restriction of processing,
e. to have the data transferred to another controller
f. also the right to object at any time to the processing of data for reasons related to the
Buyer's particular situation - against the processing of personal data concerning him, based on
Article 6(1)(f) RODO (i.e. on legitimate interests pursued by the controller).
(6) In order to exercise their rights, the Buyer should contact the Seller using the
data from § 10 of the Terms and Conditions.
(7) In the event that the Buyer considers that his/her data is being processed unlawfully, the Buyer may file a complaint to the President of the Office for Personal Data Protection.


9. DISCLAIMERS
(1) The supply of unlawful content by the Buyer is prohibited.
(2) Each order placed in the Shop constitutes a separate contract of sale and requires a separate acceptance of the Terms and Conditions. The contract is concluded for the time and purpose of fulfilling the order.
(3) In the case of a possible dispute with a Buyer who is not a Priority Buyer, the court of

(4)Any liability of the Seller towards a Buyer who is not a privileged Buyer is excluded to the extent permitted by law.
(5) Any liability under warranty against a privileged businessman is excluded.
